Memorandum of Understanding under the Joint Working Groups of Lancang-Mekong Water Resources Cooperation
On the Provision of Hydrological Information of the Lancang River in the Flood Season by China to the other five member countries
The Joint Working Groups (JWG) for Lancang-Mekong Water Resources Cooperation of the six LMC member countries, hereinafter referred to as the ‘parties’.
Recognizing timely and reliable hydrological information in the flood season is crucial to effective and scientific decision-making in flood management and disaster mitigation in the Lancang-Mekong River;
Based on the spirit of the Sanya Declaration of the 1st LMC Leaders' Meeting and the Phnom Penh Declaration of the 2nd LMC Leaders' Meeting;
Under the Lancang-Mekong Water Resources Cooperation Mechanism;
Have agrees as follows:
I. In order to promote the Lancang-Mekong Water Resources Cooperation and meet the needs of flood management and disaster mitigation of the Mekong river, the Chinese JWG agrees that China will provide the JWGs of the other five member countries with the hydrological information of the Lancang River in the flood season following the principle of friendly cooperation, mutual benefits and trust, and equality.
II. The hydrological information China will provide is that of Yunjinghong and Man'an stations located on the downstream of the China’S Lancang River.
III. All parties agree that from June 1st to October 31st every year Chinese JWG will provide the JWGs of other five member countries with data of water level and rainfall of the two stations mentioned in Article II twice a day. The first time for data provision is before 9:00 (Beijing time), including the data observed from 21:00 of the previous day to 8:00 of the current day. The second time is before 21:00 (Beijing time), including the data from 9:00 to 20:00 of the current day.
III. The Chinese JWG covers the related costs of the above hydrological information provision to the JWGs of the other five member countries.
IV. The Executive Institution of the Chinese side is the Bureau of Hydrology and Water Resources of Yunnan Province, the People’s Republic of China.
The Executive Institution of the Cambodian side is the International office, Department of Planning and International Cooperation, Ministry of Water Resources and Meteorology, the Kingdom of Cambodia.
The Executive Institution of the Laos side is the Lao National Mekong Committee Secretariat, the Lao People’s Democratic Republic.
The Executive Institution of the Myanmar side is the Directorate of Water Resources and Improvement of River Systems and Department of Meteorology and Hydrology under Ministry of Transport and Communications, the Republic of the Union of Myanmar.
The Executive Institution of the Thai side is the National Water Command Center, Office of the National Water Resources, the Kingdom of Thailand. The Executive Institution of the Vietnamese side is the Viet Nam National Mekong Committee, the Socialist Republic of Vietnam.
V. All parties agree the Implementation Plan for this Memorandum of Understanding (MOU) the main contents of which include technical details on hydrological information provision and transmission method.
Differences between the parties arising out of the interpretation or application of this MOU, or of any question affecting the provision of hydrological information in the flood season, shall be resolved through friendly consultation.
VI. This MOU shall enter into force on the date of signature by the duly authorized representatives of the parties and shall remain valid for a period of five years. The valid period of the present MOU will be extended for another five years, if the parties agree before the expiration of the present MOU. The parties will revise this MOU if they all agree.
